Who can be granted an extension as an unaccompanied minor?

You can apply to extend your residence permit in Denmark if you are an unaccompanied minor who has been granted a residence permit in accordance with Aliens Act section 9 c (3) (i) or section 9 c (3) (ii).

Different rules apply depending on whether you applied for asylum before or after 1 January 2011.

 

What are the requirements?

The requirements you need to meet in order to qualify for an extension of your residence permit depend on the date you applied for asylum in Denmark.

You can be granted an extension if you still qualify for a residence permit.

Residence permit granted to immature unaccompanied minors

If you would like to apply for an extension of a residence permit that was granted in accordance with Aliens Act section 9 c (3) (i) because you initially were found not to be mature enough to go through the application process, the Immigration Service will consider whether you have become mature enough to go through the application process. If you are found mature enough, you will need to go through the asylum application process. If you still are not mature enough, your residence permit will be extended, if you still do not have a family network or access to a reception or care centre in your home country and returning you would leave you to fend for yourself.

Residence permit granted to unaccompanied minors

If you were granted a residence permit in accordance with Aliens Act section 9c (3) (ii), you can qualify for an extension if you still do not have a family network or access to a reception or care centre in your home country and returning you would leave you to fend for yourself.

Your residence permit cannot be extended if there are grounds for revoking it.

When can you apply for an extension?

You may not submit your application more than three months before your residence permit is due to expire.

If you submit your application before the deadline, you will be permitted to remain in Denmark while your application is being processed.
 

How long can your residence permit be extended?

How many years your residence permit can be extended with depends on the date you applied for asylum. 

Residence permit as an immature unaccompanied minor

If you were granted a residence permit as an unaccompanied minor in accordance with Aliens Act section 9 c (3) (i) because you initially were found not to be mature enough to go through the application process, the Immigration Service will consider whether you have become mature enough to go through the application process. If you are found mature enough, you will need to go through the asylum application process. If you still are not mature enough, your residence permit will be extended for a year, if you still meet the requirements.

An evaluation of your maturity level will be carried out again the next time you apply for an extension. When you turn 18, your residence permit will expire and you will not qualify for an extension. After this point, you will normally have to leave Denmark. However, you cannot be deported until a decision about your application for asylum has been made.

Under very special conditions, it is possible, exceptionally, to grant a residence permit after you turn 18, cf. Aliens Act section 9 c (1).

Residence permit as an unaccompanied minor

If you were granted a residence permit as an unaccompanied minor in accordance with Aliens Act section 9 c (3) (ii), your residence permit can be extended until you are 18, if you still meet the requirements.

When you turn 18, your residence permit will expire, and you will normally have to leave Denmark.

Under very special conditions, it is possible, exceptionally, to grant a residence permit after you turn 18, cf. Aliens Act section 9 c (1).
 

Your residence permit can be extended with either 2 or 3 years at a time.

Normally your residence permit will be extended with 2 years at a time for the first 4 years. Here after it will normally be extended with 3 years at a time.

When you submit your application, you will normally need to provide us with your fingerprints and a picture of your face (biometric features) within 4 weeks. Your biometric features are required in order for you to get a new residence card.
